The court has overturned a Criminal Court conviction which found Dax took former model Suwanee "Fai'' Chaimongkol from her parents for the purpose of having sex from December 2003 to April 2005, when Fai was 15.
The girl was a willing partner, but the court found Dax was at fault because he had no intention of marrying her. The saga came to light when Fai fell pregnant. She took her infant son before the media, and claimed Dax was the father. Prosecutors took him to court in July 2006.
DNA tests revealed the child belonged to someone else, but the Criminal Court said Dax's actions had affected public morals.
He was sentenced to two years in jail and a fine of 20,000 baht, which was reduced by a quarter, and suspended for two years, in light of his useful testimony.
It also put him on probation, and ordered him to write two songs for teenagers warning against the evils of drugs and indulging in vice.
Dax appealed against the conviction. He said he had no intention of having underage sex, as he thought Fai was over 18.
The court heard that the pair met at a restaurant, when Fai gave Dax her phone number. Later she bought him a copy of For Men magazine, in which her photo appeared.
"My name is Fai, and I like jet skiing. I started skiing four years ago, when I was 17,'' said an accompanying blurb.
Witnesses told the court that Fai looked taller and older than girls the same age. Fai admitted that while they were seeing each other, she had never told Dax her age.
The court heard that when Fai fell pregnant, she sent him a text message revealing she was underage. The message said that unless he showed responsibility, her parents would take legal action.
The Court of Appeal said it disagreed with the lower court verdict, as it believed Dax did not know the girl's true age.
Outside the court, Dax said he was relieved the court had cleared his name. Even the suspended sentence suggested he had done something wrong.
"I am delighted with the verdict. It happened so long ago, I had almost forgotten about the case,'' he said. -

Actress Rungnapa "Annie'' Brook is lining up some big guns for her coming defamation battle with superstar Rattapoom "Film'' Tokongsub.
Film is suing Annie after she went on television in September last year to claim he was the father of her then three-month old child.
Film asked Annie to submit the child's DNA for a test to prove if he was the father, but she has refused.
The Criminal Court in Ratchada on Wednesday called in Annie to hear the charges. She denied them, and named a list of six witnesses she intends to call in her defence.
They include the hosts of Channel 3 programmes on which Annie appeared at the height of the paternity saga. She will call presenters Wittawat Sunthorawineth (Tee Sip) and Sorayut Suthasanajinda (Ruang Den Yen Ni) as defence witnesses. She is also calling her obstetrician.
Film did not turn up to the hearing. His lawyer Supan Seuahan told the court he proposed calling seven witnesses, including Film himself; director and mentor Poj Anon, who Annie is suing for defamation in relation to the same dispute; Film's mother; a DNA expert; and former actor Methee Amornwuthikul, an ex-boyfriend of Annie's.
Methi said Annie falsely claimed to have fallen pregnant with his child when they were seeing each other about 11 years ago.
Annie said she would like the chance to talk to Film, as the two sides had not spoken since the saga began.
The court granted her application for bail, and called both sides in for talks on Nov 7. -

Model Saruta "Oiy'' Ruangwiriya denies she is fixated with her honour after she refused to accept an apology by A-list actress Chompoo "Araya'' Hargate for a Twitter message which suggested she was less than attractive.
An epic battle between the two, played out through the media, has stretched into its second week after a friend of Chompoo's left a message on Chompoo's Twitter account asking: "Who would like a face like Oiy's?''
The week before, Oiy sniped at Chompoo for remarks she thought were condescending. Reporters had asked Chompoo about Oiy allegedly claiming to have gone steady with Chompoo's boyfriend, Witsarut "Nott'' Rangsisipipat.
Oiy denied making the comment, saying she and Nott were merely friends.
However, she was unimpressed with Chompoo's response: "I have invested too much in myself and am made of better things than to respond to such remarks.''
Oiy took this to mean that Chompoo was looking down at her. Oiy said while she might not be as pretty as Chompoo, she had managed to survive in the industry more than 10 years.
Chompoo declined to respond, until a Twitter message, supposedly penned by a friend who has access to her Twitter password, revived their simmering dispute and forced her to apologise to Oiy.
"I didn't write the tweet. It was a gang of friends of mine who like to play around. I would like to take responsibility, as far it goes,'' Chompoo told reporters.
Asked whether she would like to say sorry in person to Oiy, Chompoo said she had considered it, but thought an apology through the media should be enough to satisfy Oiy's dignity.
Oiy said she took exception to Chompoo's comments, as the dignity remark suggested she thought Oiy was not worthy.
"Why does she always have to imply she's better, that she's smarter and sexier? Why is it always a competition with her?'' she asked.
The model also noted that Chompoo had failed to mention her by name.
Asked if she was not fixated with her honour, given that Chompoo probably wanted the whole saga to just go away, Oiy replied that her honour was as important as anyone else's. She was now considering taking legal action against Chompoo. -

Transgender model and actress Treechada "Poy'' Marnyaporn has turned down an offer to work abroad for a 10 million baht fee, when she realised she would have to stay on an oil magnate's luxury cruiser.
An oil magnate asked a Thai woman called Kung to contact Poy on his behalf.
"At first she told me he was prepared to pay me 10 million baht to work in Europe as a model,'' Poy said.
"The next day, Kung called to apologise, saying she did not know the whole story. The oil magnate actually wanted me to stay on his boat for a month, cruising the Mediterranean,'' she said.
Kung knew immediately that Poy would not accept the offer, and apologised for misleading her.
Poy's boyfriend, Peerapong "M'' Kaoropthai, said he was miffed to hear about the magnate's cheeky offer.
He joked with Poy that if anything happened to her while she was away, he would not be held responsible.
"Anyone who knows M wouldn't dare extend such an invitation,'' joked Poy. "They'd be too scared.''
